Terms and Conditions for Solitaire

These Terms and Conditions (the “Terms”) constitute a binding agreement between you and Assouline Publishing, Inc., together with its affiliates, successors, and assigns (“Operator,” “we,” “us,” “our,” or “Assouline”), governing your access to and use of the Assouline Online Solitaire Game, an online solitaire game, and any related website, mobile application, software, content, features, and services identified as the Assouline Online Solitaire Game (collectively, the “Game”).

By accessing, or using the Game, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree to these Terms, do not access or use the Game.

Article 1A — Nature of the Game (outside of United States of America and outside European Union countries and outside the United Kingdom)

This Section 1A describes the nature of the Game for users physically located either outside of the United States of America or outside countries of the European Union or outside the United Kingdom.

  1. Game Description. The Game is an online version of Klondike solitaire card game available at assouline.com, eu.assouline.com and ap.assouline.com. There are seven columns of cards, one stock and four foundations. You build each foundation from Ace to King in one suit and build columns in alternating colors, counting down. Only a King can fill an empty column. The clock starts on your first move. or more. The score cannot go below zero. Undo puts the cards and the points back, which counts as a move.

  1. Entertainment only. The Game is provided solely for personal entertainment. It does not offer or award money, property, merchandise, gift cards, credits redeemable outside the Game, or anything else of real-world or transferable value.
  2. No prize or gambling component. The Game does not involve or constitute:
    1. wagering or staking money or anything of value;
    2. gambling, gaming for consideration, or betting;
    3. a sweepstakes, lottery, raffle, promotion, or prize drawing;
    4. a contest offering cash, prizes, or other items of value;
    5. an opportunity to win or lose money or anything of value; or
    6. any cash-out, redemption, exchange, or transfer of Game results, scores, points, achievements, rankings, Virtual Items, or other Game features for money or anything of value.
  3. No entry fee. No payment is required to play the Game. The Game offers no optional purchases, subscriptions, advertising-removal features, cosmetic items, or other paid functionality whatsoever.
  4. No monetary value. Scores, statistics, rankings, achievements, points, cosmetic items, boosters, or other digital features made available through the Game, if any, have no cash value, are not property, and may not be sold, transferred, exchanged, redeemed, or used outside the Game.
  5. Game results. Any score, ranking, win, loss, completion time, or other result exists solely within the Game. Operator does not represent that any result reflects a user’s ability to earn money, win a prize, or achieve any outcome outside the Game.

Article 1B — Nature of the Game (inside the United States of America or inside European Union countries or inside the United Kingdom)

This Section 1B describes the nature of the Game for users physically located either inside the United States of America or inside a country from the European Union or inside the United Kingdom.

  1. Game Description. The Game is an online version of Klondike solitaire card game available at assouline.com, eu.assouline.com and ap.assouline.com. There are seven columns of cards, one stock and four foundations. You build each foundation from Ace to King in one suit and build columns in alternating colors, counting down. Only a King can fill an empty column. The clock starts on your first move. or more. The score cannot go below zero. Undo puts the cards and the points back, which counts as a move.

  1. Entertainment with opportunity for Prize winning. The Game is an online version of Klondike solitaire card game. The Game is provided for personal entertainment and offers the opportunity of winning a Prize, pursuant to the adherence to the rules described herein.
  2. The Prize. Limited-edition version of an Assouline-branded deck of playing cards (estimated total market value, as of October 26, 2026): $45. The Prize includes taxes and shipping to one location within the United States or a country of the European Union or the United Kingdom.
  3. Eligibility for Prize Winning. In order to be eligible to win a Prize in the Game, you must:
    1. Be a citizen or permanent resident of either (a) the United States or of (b) a country member of the European Union or of (c) the United Kingdom;
    2. Be at least 18 years of age;
    3. A human person;
    4. Be physically located in either (a) the United States or (b) a country member of the European Union or (c) the United Kingdom when playing the Game (as determined by the IP address used to play the Game; use of a Virtual Private Network (“VPN”) to circumvent this requirement and misrepresent physical location will disqualify you from eligibility);
    5. Play and win at least one full round of the Game in “Leaderboard Mode,” by signing up with a player name (2 to 24 characters: letters, numbers, spaces, apostrophes, hyphens, periods and underscores) and valid email address to save your won round to the public-facing Leaderboard. The Leaderboard shows your self-selected player name, time, card moves, and score. It does not show your email address. Assouline may refuse a name that impersonates Assouline, another player, a role such as "Admin" or "Player 5" or otherwise violates these Terms.
    6. Save your fully completed and played round of the Game to the Leaderboard within two hours of having played and completed the round. A round left unsaved, played offline, or submitted more than two hours after completion will not be saved or recorded on the Leaderboard.

Please note that Assouline also keeps a shortened record of the network address and browser used to submit the round to check Leaderboard entries for Prize eligibility.

  1. No Payment or Purchase is required. No payment or purchase is required to enter or win, and no purchase of any product will increase your chances of winning.
  2. Prize Drawing. Two Prize Winners (the EU Prize Winner and the US Prize Winner) are drawn every Month according to the following criteria:
    1. Competition opens: 12:00 a.m. Eastern Time on 26 October 2026.
    2. October Month: ends 11:59pm Eastern Time on 31 October 2026.
    3. November Month: starts 12:00 a.m. Eastern Time on 1 November 2026 and ends 11:59pm Eastern Time on 30 November 2026.
    4. Subsequent Months are defined as beginning on the first of that month at 12:00 a.m. Eastern Time and ending at 11:59pm Eastern Time on the last day of that Month.
    5. Monthly Prize Drawing: on the first business day at the start of a new Month,
      1. US Prize Winner: the player with a corresponding IP address located in the United States with the highest score on the Leaderboard as of 11:59pm Eastern Time on the last day of the preceding Month will be deemed the US Prize Winner, after verification of rules compliance by Assouline; and
      2. EU Prize Winner: the player with a corresponding IP address located in either a European Union country or the United Kingdom with the highest score on the Leaderboard as of 11:59pm Eastern Time on the last day of the preceding Month will be deemed the EU Prize Winner, after verification of rules compliance by Assouline.
      3. Leaderboard Ranking is determined by highest score, then fastest time, then fewest moves, then the earlier saved game. Rounds that are: (a) won in under 60 seconds; or (b) averaged under a quarter of a second per move; or (c) scored above 13,000 will be excluded from the Leaderboard. Assouline may decline any score that breaks these rules or that it cannot verify as a genuine win.
      4. The Leaderboard completely resets at 12:00 a.m. Eastern Time on the first day of each Month and all scores are erased on the public-facing Leaderboard.
      5. Please note that there may be a discrepancy between the names that appear at the top of the public-facing Leaderboard, and the players who are actually eligible to be deemed Winners.
  3. Redemption. If you are selected as either a US Prize Winner or an EU Prize Winner, you will be contacted via the email address you used to enter your round on the Leaderboard with a Prize Announcement Email from Assouline. You will have 24 hours from the time the Prize Announcement Email is sent to accept the Prize. In order to accept the Prize, Winner will be required to provide Assouline with a government-issued photo ID (like a driver’s license or passport) to confirm Winner’s legal name, date of birth, citizenship and residency as well as a valid physical mailing address (within the United States or a country in the European Union or the United Kingdom) to which the Prize will be sent. If you do not or cannot (due to ineligibility) accept the Prize within that window, another winner will be selected following the same process as the first winner. This process will repeat until either (a) a winner accepts in the appropriate time delay or (b) the end of that Month arrives. Prizes are non-transferable and cannot be exchanged for cash. Any portion of the Prize that is not used is forfeited.
    1. Exclusions from Redemption. You will be excluded from being awarded and collecting the Prize if you do not (a) sign a waiver releasing Assouline from any liability related to the use or enjoyment of the Prize; or (b) you do not comply with the applicable rules and agree to these Terms and Conditions as required by the Operator; or (c) there is any reasonable suspicion that you are utilizing bots or non-human methods to play the Game; (d) you have misrepresented your physical location when playing the Game by employing a VPN.
  4. Violations. Any violation of Assouline’s policies, or any reasonable suspicion of engagement in any illegal behavior, in Assouline’s sole discretion, may result in forfeiture of your Prize. Any public statements disparaging, inaccurate or reflecting negatively on Assouline or its brand or affiliates may also result in cancellation of your Prize. Any false information provided for the Game by any participant or non-compliance with these rules may result in your elimination from the Game.

Article 2 — Eligibility and Users Under the Age of Majority

  1. Minimum age. You may use the Game only if you are at least 18 years old and are legally permitted to use the Game in your location. The Game is not directed to children or minors under 18.
  2. Minor users. If you have not reached the age of legal majority where you reside, you may use the Game only with the consent and supervision of your parent or legal guardian. By permitting a minor to use the Game, the parent or legal guardian agrees to these Terms on the minor’s behalf and accepts responsibility for the minor’s use of the Game.
  3. Authority and capacity. By using the Game, you represent that:
    1. you satisfy the eligibility requirements stated in this Article;
    2. you have the legal capacity and authority to agree to these Terms;
    3. your use of the Game is not prohibited by applicable law or any binding agreement; and
    4. you have not previously been suspended or prohibited from using the Game, unless Operator has expressly authorized your renewed use.
  4. Guardian responsibility. A parent or legal guardian is responsible for supervising a minor’s use of the Game.

Article 3 — License and Permitted Use

  1. Limited license. Subject to your continuing compliance with these Terms, Operator grants you a limited, personal, revocable, nonexclusive, nontransferable, non-sublicensable license to access and use the Game on a compatible device solely for your private, noncommercial entertainment.
  2. Restrictions. You shall not, directly or indirectly:
    1. copy, reproduce, distribute, publicly display, publicly perform, sell, rent, lease, sublicense, or commercially exploit the Game or any portion of it;
    2. modify, adapt, translate, reverse engineer, decompile, disassemble, decode, or attempt to derive the source code, underlying ideas, algorithms, or nonpublic structure of the Game, except to the limited extent such a restriction is prohibited by applicable law;
    3. use bots, scripts, macros, emulators, automation tools, cheats, exploits, modified software, or unauthorized third-party software in connection with the Game;
    4. interfere with the Game’s operation, security, servers, networks, data, or other users;
    5. bypass, disable, defeat, or circumvent any technological, usage, geographic, security, or access restriction;
    6. scrape, harvest, index, mine, or systematically collect Game content, account information, or user data;
    7. upload, transmit, or introduce malware, malicious code, or any material designed to disrupt or damage the Game;
    8. remove, obscure, or alter any copyright, trademark, attribution, or proprietary-rights notice;
    9. use the Game to advertise, solicit, conduct commercial activity, or provide services to another person;
    10. use the Game or any Game result in connection with wagering, gambling, sweepstakes, contests, prizes, financial transactions, or any activity involving money or items of value;
    11. manipulate scores, rankings, statistics, gameplay, advertising metrics, or technical systems; or
    12. use the Game in any unlawful, fraudulent, abusive, deceptive, or unauthorized manner.
  3. Updates. Operator may provide patches, updates, upgrades, modifications, or replacement versions of the Game. Such changes may be installed automatically where permitted by your device settings. Updates form part of the Game and are governed by these Terms.
  4. Technical requirements. You are responsible for obtaining and maintaining all devices, operating systems, software, internet connectivity, and telecommunications services necessary to use the Game, together with any associated charges.

Article 5 — User Conduct

  1. General standard. You shall use the Game in a lawful manner and shall not interfere with another person’s access, enjoyment, privacy, or security.
  2. Prohibited content and conduct. If the Game permits usernames, profiles, messages, submissions, or other user-provided material, you shall not submit or communicate material that:
    1. is unlawful, threatening, harassing, defamatory, obscene, exploitative, or intentionally deceptive;
    2. infringes or misappropriates another person’s intellectual-property, privacy, publicity, or other rights;
    3. reveals another person’s personal information without authorization;
    4. promotes unlawful conduct or transactions involving wagering, gambling, prizes, or items of value;
    5. contains malicious code or disrupts the Game; or
    6. falsely suggests sponsorship, endorsement, affiliation, or approval by Operator or another person.
  3. Enforcement. Operator may investigate suspected violations and may remove content, restrict functionality, reset Game data, suspend or terminate accounts, block IP addresses, or take other reasonable action to protect the Game, Operator, or other users.

Article 8 — Intellectual Property

  1. Operator materials. The Game, including its software, source and object code, gameplay presentation, audiovisual elements, artwork, graphics, animations, text, designs, interfaces, databases, compilations, sounds, music, trademarks, logos, and all related intellectual-property rights, is owned by or licensed to Operator.
  2. Reserved rights. Except for the limited license expressly granted in Article 3, no right, title, license, or interest in the Game or any Operator materials is transferred to you. Operator and its licensors reserve all rights not expressly granted.
  3. Feedback. If you voluntarily provide suggestions, ideas, comments, or other feedback concerning the Game, you grant Operator a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable right to use, reproduce, modify, distribute, commercialize, and otherwise exploit that feedback for any lawful purpose, without compensation or attribution to you.
  4. User material. You retain any rights you hold in material that you submit through the Game. To the extent necessary to operate, maintain, improve, display, or provide the Game, you grant Operator a worldwide, nonexclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify for technical purposes, display, and transmit that material. This license ends when the material is deleted from Operator’s active systems, except for copies retained in routine backups, records required for legitimate operational purposes, and material shared with others who have not deleted it.

Article 9 — Privacy and Electronic Communications

  1. Privacy policy. Operator’s collection, use, disclosure, retention, and protection of all information collected in association with the Game are described in the privacy policy available at https://ap.assouline.com/pages/privacy-policy. The privacy policy is incorporated into these Terms by reference to the extent permitted by applicable law.
  2. Device and usage information. The Game may process device, technical, gameplay, diagnostic, and usage information as described in the privacy policy and applicable permission notices.
  3. Electronic communications. You consent to receive agreements, disclosures, notices, and other communications electronically through the Game, your account, or the contact information you provide. You are responsible for maintaining current contact information and retaining copies of communications relevant to your use of the Game.
  4. Permissions. Certain features may request device permissions. You may manage permissions through your device settings, but disabling a necessary permission may prevent the affected feature from functioning.

Article 10 — Availability, Changes, and Maintenance

  1. No continuous availability. Operator does not guarantee that the Game will be uninterrupted, error-free, secure, compatible with every device, or available in every location or at every time.
  2. Changes to the Game. Operator may add, modify, remove, rebalance, suspend, or discontinue Game content or functionality for operational, technical, security, legal, or business reasons. Such changes may affect saved data, scores, rankings, achievements, or device compatibility.
  3. Maintenance and outages. The Game may be unavailable because of maintenance, updates, technical failures, network conditions, third-party services, events beyond Operator’s reasonable control, or discontinuation.
  4. Data preservation. You are responsible for preserving any information available for lawful export through the Game. Operator is not obligated to retain account or gameplay data except as stated in the privacy policy or required by applicable law.

Article 11 — Disclaimers

  1. As-is service. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND.
  2. Disclaimed warranties. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OPERATOR AND ITS LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, SECURITY, AVAILABILITY, AND COMPATIBILITY.
  3. No guaranteed results. Operator does not warrant that:
    1. the Game will satisfy your expectations;
    2. gameplay will be uninterrupted, secure, or error-free;
    3. defects will be corrected;
    4. Game results, statistics, rankings, or saved data will be accurate or preserved; or
    5. the Game or systems through which it is provided will be free from harmful components.
  4. Mandatory rights preserved. Nothing in these Terms excludes any warranty or consumer right that cannot lawfully be excluded or waived.

Article 12 — Limitation of Liability

  1. Excluded damages. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OPERATOR AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, GAME PROGRESS, SCORES, VIRTUAL ITEMS, OR USE, ARISING OUT OF OR RELATING TO THE GAME OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  2. Liability cap. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF OPERATOR AND THE OTHER PARTIES IDENTIFIED IN SECTION I OF THIS ARTICLE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE GAME OR THESE TERMS WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS.
  3. Allocation of risk. The disclaimers and limitations in these Terms reflect a reasonable allocation of risk and are fundamental elements of the basis on which Operator provides the Game, including where the Game is provided offered with no Prize (for users physically located outside of the United States or outside of a European Union country or outside of the United Kingdom, see Article 1A).
  4. Nonwaivable liability. These Terms do not limit liability to the extent such limitation is prohibited by applicable law. If a jurisdiction does not permit a particular exclusion or limitation, that exclusion or limitation will apply only to the maximum extent permitted in that jurisdiction.

Article 13 — Indemnification

  1. User indemnity. To the fullest extent permitted by applicable law, you shall defend, indemnify, and hold harmless Operator and its affiliates, licensors, service providers, officers, directors, employees, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable professional fees arising out of or relating to:
    1. your unlawful or unauthorized use of the Game;
    2. your material breach of these Terms;
    3. material you submit through the Game; or
    4. your infringement or violation of another person’s rights.
  2. Procedure. Operator may control the defense and settlement of an indemnified claim, provided that Operator will not settle a claim in a manner that imposes an admission of wrongdoing or a nonmonetary obligation on you without your consent, which shall not be unreasonably withheld. You shall reasonably cooperate in the defense.
  3. Consumer limitation. This Article does not require a consumer to indemnify Operator for Operator’s own unlawful conduct, gross negligence, willful misconduct, or other liability that cannot lawfully be shifted to the consumer.

Article 14 — Suspension and Termination

  1. Termination by you. You may stop using the Game at any time. If account-deletion functionality is available, you may request deletion through the method described in the privacy policy.
  2. Termination by Operator. Operator may suspend, restrict, or terminate your access if:
    1. you violate these Terms;
    2. your conduct creates a security, legal, operational, or reputational risk;
    3. your account is used fraudulently or without authorization;
    4. suspension is reasonably necessary to protect the Game, Operator, another user, or a third party; or
    5. Operator discontinues the Game.
  3. Effect of termination. Upon termination, the license granted to you ends immediately, and you shall cease using and, where applicable, uninstall the Game. You may lose access to account data, saved progress, scores, rankings, achievements, and the Leaderboard.
  4. Survival. Provisions that by their nature should survive termination will survive, including provisions concerning ownership, feedback, disclaimers, limitation of liability, indemnification, dispute resolution, and interpretation.

Article 15 — Changes to These Terms

  1. Revisions. Operator may revise these Terms to reflect changes to the Game, business practices, security requirements, or applicable legal obligations.
  2. Notice. If a revision materially affects your rights or obligations, Operator will provide reasonable notice through the Game, your account, or another appropriate electronic method before the revision becomes effective, unless an earlier effective date is reasonably necessary to address an urgent legal, security, fraud-prevention, or technical matter.
  3. Acceptance of revised Terms. Your continued use of the Game after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Game.

Article 16 — Governing Law and Dispute Resolution

  1. Governing law. These Terms and any dispute arising out of or relating to them or the Game are governed by the laws of New York state, without regard to conflict-of-laws principles, except to the extent applicable law requires otherwise.
  2. Exclusive forum. Subject to any mandatory consumer forum rights, each party submits to the exclusive jurisdiction of the state and federal courts located in New York state for any dispute arising out of or relating to these Terms or the Game.
  3. Jury-trial waiver. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY KNOWINGLY AND VOLUNTARILY WAIVES ANY RIGHT TO A TRIAL BY JURY IN A PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE GAME.
  4. Equitable relief. Nothing in these Terms prevents either party from seeking temporary or preliminary equitable relief from a court of competent jurisdiction to prevent actual or threatened misuse of intellectual property, unauthorized system access, or other irreparable harm.

Article 17 — General Terms

  1. Entire agreement. These Terms, together with the privacy policy and any additional terms presented for a specific Game feature or purchase, constitute the entire agreement between you and Operator concerning the Game and supersede prior or contemporaneous understandings concerning the same subject matter.
  2. Order of precedence. If these Terms conflict with additional terms expressly applicable to a particular feature or transaction, the additional terms control solely with respect to that feature or transaction.
  3. Severability. If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
  4. Waiver. A failure or delay by Operator in exercising a right or remedy does not waive that right or remedy. A waiver is effective only if made in writing by an authorized representative of Operator.
  5. Assignment. You may not assign or transfer these Terms or any right under them without Operator’s prior written consent.
  6. No third-party beneficiaries. Except for the Operator parties expressly protected by the disclaimers, liability limitations, and indemnification provisions, these Terms do not create rights in any third party.
  7. Force majeure. Operator is not responsible for delay, interruption, or failure caused by circumstances beyond its reasonable control, including natural disasters, utility or telecommunications failures, cyberattacks, labor disruptions, governmental actions, civil disturbances, public-health events, failures of third-party platforms, or widespread internet outages.
